  1. General Information

The present terms and conditions shall apply to the products sold exclusively by the enterprise under the distinctive name “Fora Agency”, owned by Georgia Kostara, located at 18, P. Kiriakou str., 151 24, Marousi, Athens, Greece, with VAT Reg. No. EL079225954, and the online store www.forashop.gr (“Fora Shop”). The user agrees that by accessing and using the said online shop, he/she accepts automatically the present terms and conditions.

Georgia Kostara, who owns Fora Agency and relevant e-shop (www.forashop.gr), designs  and sells original scarves of high quality designed in Athens, Greece and manufactured in  Europe, as well as various fashion accessories, such as clothing, bags, jewelry, with mastered hand craftsmanship.

The user of the e-shop may commence the order submission process, either as a visitor or by creating a personal account and registering with the enterprise’s online store. To register or log in to the online store, the full name, mailing address, billing address, contact phone number and e-mail are required. This information remains completely confidential. The user should keep his/her password confidential and will be responsible for use of the account and password.

  1. Intellectual Property Rights

Fora Agency is the sole owner of all intellectual property rights in the products sold through www.forashop.gr, including all databases, software, website designs, audio, video, text, photos, and graphics relating to the products, as well as the trademarks and logos contained therein. The users of the online shop are not allowed to use trademarks and/or logos of the Fora Shop without its permission.

  1. Products, Prices, Purchases & Payments

3.1. The Products are displayed on the e-shop as accurately as possible regarding the colors, features, specifications, details and availability. However, we do not guarantee that the actual colors, features, specifications and details will be accurately reflected on your electronic device. By placing your order, the user accepts and agrees that he/she likes and is fully satisfied by the product’s features, unless there is an actual error or default on the product purchased by the user. All products are subject to availability, and we cannot guarantee that all items will be in stock. We reserve the right to discontinue any products at any time, as well as change any prices.

3.2. The sale prices of the products are displayed on the website. Prices are indicated in euros, all applicable taxes included. Fora Shop reserves the right, at its own discretion and according to the modalities of which it will be the sole judge, to propose promotional offers or price discounts. Prices do not include delivery costs that may be applicable to the delivery of products, which are invoiced in addition to the price of products and burden the buyer, unless the order succeeds the total amount of 200,00 Euros, in which case the shipping is free. The amount of the applicable delivery charges will be indicated before the validation of the order by the purchaser. The applicable price is the one displayed on the website at the time of registration of order by the purchaser.

3.3. The order of products is submitted by completing and sending a special order form with user’s personal details, available at the online store. Before finalizing the order, the user receives through link a disclaimer with the terms of the sale and then activates/checks the icon “I have read and accept the purchase terms and conditions”. The user, before checking out, receives a message with all information for the purchase (ie. total price of ordered products, including VAT, all additional shipping charges, and estimated delivery time). Where charges cannot be accurately calculated in advance, such as customs duties, customs clearance costs or other costs, they are charged directly to the purchaser by his/her local authorities at the place of receipt of the delivery.

The only accepted means of payment are the following: online card payment via Viva Wallet, as well as Klarna payment (https://www.vivawallet.com/cy_el/). The invoice corresponding to each order is sent to the buyer by e-mail, to the address indicated in his registration form.

Fora Shop reserves the right to suspend or cancel any order and/or delivery in case of non-payment of any amount due by the purchaser, in case of payment incident, or in case of fraud or attempt of fraud related to the use of the website.3.4. The order is deemed to have been received by the enterprise from the moment the user receives an order status update with the indication “Your order has been received and is in the process of being processed”. The status of order is updated when changes occur during the order management. The user must check the “Receipt and Processing of the Order” and immediately inform the enterprise (within 3 hours from the time of receipt of the electronic notice) be email of any error, otherwise the information mentioned in the “Confirmation of receipt and order processing” will be applied to the relevant sale agreement. During the processing of each registered order, the stock availability of products is confirmed. If the availability or delivery time differs from that listed on the product page, the user will receive a new written update. The order is considered binding and the sale is deemed to have been completed by sending and receiving the enterprise’s e-mail with the indication “Your order has been completed”. The products are delivered within a period not exceeding five (5) working days for Greece and ten (10) for abroad from the date of order confirmation.

 

 

  1. Product Return policy

The user has the right to withdraw from the purchase of a product, only in the case of a proven defective or damaged product, by informing the enterprise by e-mail about the specific defective product, the exact errors on the product, and by sending relevant photos showing the fault and declaring intention to return the order within three (3) working days from the receipt of the product. Return notices received outside of this time frame or without notice may be rejected by the enterprise. The said request will be processed within another three (3) working days by the enterprise and the user will receive an email informing that the return is being processed. In case that a product is declared as defective by the purchaser, the enterprise is expressively reserved for the diagnosis of the product as defective.

If all the above conditions are collectively duly met, the enterprise will notify the customer by an e-mail and will make a replacement at its delivery costs within fifteen (15) working days. If a product is damaged by external factors during delivery, the enterprise will cover the shipping costs. If that’s not the case, the purchaser is strongly advised to return the products via a trackable method. The enterprise shall not be burdened by any returning costs or expenses. Those are borne by the purchaser in all cases of return.

The enterprise does not provide a guarantee, nor does it guarantee protection for a suitably sold product for any particular purpose.

Refunds are not accepted by the enterprise as a policy at any case.

  1. Liability – Disclaimer

In no event will Fora Agency be liable towards the user or customer or any third party for any direct or indirect damages, including lost profit, lost revenue, loss of data, or any other damages arising from the products or services provided with Fora Shop, even if advised beforehand. In any case, our liability for any cause whatsoever is limited to the amount paid by the user or customer, if any, during the period of six (6) months prior to any cause of action arising.

The present services and products are provided on an as-is and as-available basis. You agree that the use of Fora Shop will be at your sole risk. We disclaim all warranties in connection with the products sold and the customers’ use, including, without limitation, the implied warranties of merchantability, fitness for a specific purpose, and non-infringement. We will assume no responsibility or liability for any errors, mistakes, damages of materials, personal injury or property damages of any nature related to our products or services.

 

 

 

  1. Miscellaneous

All online transactions with Fora Shop are governed by Greek law. The website was created and controlled by the enterprise Fora Agency and the Greek laws govern the use of the site and its interpretation. If the user chooses to access the site from another country, he/she has the responsibility to follow the laws of that country.

Any dispute arising out of the contractual relationship between the enterprise and the user will be settled by the competent Courts of Athens, Greece.

If any part of the agreement under these terms is found to be invalid or unenforceable by a court order, the rest of the contract will continue to apply.

The enterprise may conclude an agreement for the assignment of its obligations with a third party.

The user will not be entitled to assign or transfer his/her rights or obligations under the sales contract to a third party.

  1. Personal Data

Fora Shop respects your privacy and is committed to protecting your personal data. This privacy notice is to provide you with information concerning the processing of your personal data when using our website and related services (ex. sign up to our Newsletter, purchase a product, take part in a competition etc.). Personal data within the meaning of article 4 of the EU General Data Protection Regulation (GDPR), are all the information, such as name, home address, email address, telephone, on-line ID (e.g. cookies, IP address, email address), concerning natural persons whose identity is identified or can be identified directly or indirectly. 7.1. The personal data that we collect and process when you are using the services of our website

You can contact us through our website by filling in the designated contact form or subscription form (create an account), by placing your order, by corresponding with us by post, email, telephone or otherwise, by entering into a competition, promotion or survey. The data that you provide (such as name, billing address, delivery address, telephone number, email address, bank account, payment card details  etc.) will be collected, used and stored by Fora Agency only for the necessary time and in order to serve the purpose for which the communication was made. Once your request and/or question and/or purchase order are served and if no contractual relationship arises between the parties, the storage of the data is not necessary for the intended purposes and the data is deleted. As for users to know, their data collected according to the above may be transferred to competent partners of the company depending on each case. We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data), nor do we collect any information about criminal convictions and offences.

You can also, through our website, subscribe to our Newsletter in order to receive personalized information about our products, services or in order to invite you to take part in promotions, contests or surveys. Registration is done by filling an on-line application form, in which personal data (such as name, email address, country of residence and other information) are voluntarily submitted by you. If you no longer wish to receive Newsletters, you are always given the right to do so (“unsubscribe” button). Lastly, you can any time by sending an email to info@forashop.gr either request your deletion from the list of users receiving Newsletter or request modification of the data you provided to us when you subscribed.

Furthermore, through our website, our company may collect and process your personal data for trading purposes. When you purchase products through our website, we use your information to register you as a new customer, process the purchase, manage payments, fees and charges, collect and recover money, complete your order and to provide you with the products you have ordered, notify you about changes to our terms or privacy policy, enable you to take part in competitions or promotional offers, and make recommendations about goods. As to serve your order, you provide us with personal data such as your name, address, telephone or other details. We will process your data for the time required to manage the purchase of the acquired products, including the period of time that any refunds, withdrawals, complaints or claims related to the purchase may arise. Some of your information that you may have allowed us to retain for more, we will do so until you tell us to stop. Furthermore, you may receive marketing communications if you have requested information from us or purchased goods from us and, in each case, you have not opted out of receiving that marketing notifications. Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product purchase, service experience or other transactions.

Therefore, we will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances: where we need to perform the contract, where it’s necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests, where we need to comply with a legal or regulatory obligation.

7.2. Your duty to inform us of personal data changes or failure to provide us your personal data

It’s important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

Where we need to collect personal data by law or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (ex. to provide you with goods). In this case, we may have to cancel a product you have ordered, but we will notify you if this is the case at the time.

7.3. Personal data protection

Personal data are stored on a secure, password and firewall-protected server. Fora Agency designed appropriate technical and organizational security measures to ensure that personal data are confidential and intact and to protect them from being accidentally or unlawfully destructed, lost, alternated or disclosed without authorization. The measures taken also prevent others from having access to your personal data when they are transmitted, stored or processed in any way and prevent every other unlawful form of processing, under applicable law. The processing of personal data is carried out solely by Fora Agency which is the Data Controller and responsible for your personal data and bound by strict confidentiality obligations. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

7.4. Legal basis of processing data and data storage:

Fora Agency collects and processes personal data on the legal basis of either the legal obligation to which we are committed or the execution of a contract with you or the legitimate business interest when this overrides your interest in protecting your data. Otherwise, the legal basis of processing is your consent (we will ask you to provide us with your consent before we start processing your data). Fora Agency may keep a record and process personal data of users. Users, in compliance with the terms of the European regulation GDPR, will be informed about that through our website. We will not disclose or bring to public personal data of users. Collaborators of Fora Agency may have access to data records only to promote, support and improve the company’s services, as well as the company’s relationship with every user.

Our company stores your personal data for as long as you continue to interact with us and only in case data are necessary for the reason that have been collected and processed, as given above. Otherwise, we will retain your data until any responsibility may arise from the processing, according to the applicable legislation or until we do not need to keep them according to the law ex. we need to keep them for tax, accounting or legal purposes. We also retain them until you ask us to delete them, or until your consent is withdrawn, or until you object in the processing data which legally based to company’s legitimate interest. As to determine the storage time of your personal data, we also take into account the nature and quantity of your data, the purpose of processing, data’s safety etc. In any case, your data is stored securely. After the end of the storage period, personal data is destroyed by the company’s physical files and systems.

Being users of our website you have the status of the subject of personal data and in compliance with the general data protection regulation of the EU (GDPR) (Articles 15 and fol.), you enjoy the following rights as regards to your personal data:

In addition, you have the right to request at any time the updating, access, rectification, provision of extra data, limitation of processing or your personal data be deleted without any charge. Finally, you may at any time object to the procession of your data and receive back the data that you gave us.

We may have to share your personal data with various third parties, companies or individuals, with whom we deal such as our suppliers, service providers acting as processors who provide IT and system administration services, professional advisors including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

Being Data Controller, our company does not transfer personal data to third countries or international organizations for which there is no relevant decision of the European Commission unless legislation is complied with. If such transfer takes place, your prior information is required.
